Abstrakt EN:

On 9 September 2016 the Act on the principles of shaping remuneration of persons managing certain companies entered into force. It regulates the way of exercising rights resulting from the shares of commercial companies possessed by the State Treasury, local government units, state and municipal legal persons with regard to the remuneration of the members of management and supervisory bodies in certain companies. The law implements the constitutional principle of the social market economy. It is supposed to combine market requirements with the elements of social sensitivity. It should be noted that the regulation by the state of issues concerning the shaping of remuneration in private law companies which are controlled by the state falls within the principle of the social market economy, is consistent with European Union law and exists in other European legal systems. The legislator's motivation expressed in the explanatory memorandum to the law clearly indicates an attempt to combine the concept of market economy with the concept of the welfare state.
